1. Acceptance of Terms

By accessing or using FitSignal (“Service”), operated by GroundForm Software LLC (“Company,” “we,” “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

FitSignal is a product-market fit measurement platform that enables users to create surveys, collect customer feedback, and analyze PMF scores. The Service includes web applications, APIs, embeddable widgets, and related tools.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must promptly notify us of any unauthorized access.

4. Acceptable Use

You agree not to:

Use the Service for unlawful purposes or to violate any laws
Send unsolicited surveys (spam) to individuals who have not consented
Attempt to reverse-engineer, decompile, or extract source code from the Service
Interfere with or disrupt the Service or its infrastructure
Impersonate any person or entity or misrepresent your affiliation

5. Your Data

You retain ownership of all data you upload to the Service (“Your Data”). You grant us a limited license to process Your Data solely to provide the Service. We will not sell or share Your Data with third parties except as described in our Privacy Policy.

6. Billing & Plans

Paid plans are billed monthly or annually as selected. Prices may change with 30 days' notice. You may cancel at any time; access continues until the end of the current billing period. For information about refunds, please see our Refund Policy.

7. Intellectual Property

The Service and its original content (excluding Your Data) are owned by GroundForm Software LLC and protected by applicable intellectual property laws. The FitSignal name and logo are trademarks of GroundForm Software LLC.

8. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may request export of Your Data within 30 days of termination.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
